1.GENERAL TERMS AND CONDITIONS  

Dear Customer please read the General Terms and Conditions of Online Store Floridus aroma carefully.

These General Terms and Conditions (hereinafter referred to as “Terms”) apply to the use of online store Floridus aroma, accessible via direct link www.floridusaroma.com (hereinafter referred to as “Online Store”) as well as to the purchase contracts concluded at the Online Store and to all related services provided by us. Purchase contracts are an agreement between you (hereinafter referred to as “You” or “Customer”) and SELFFLES d.o.o., with its registered address at Dol pri Borovnici 58 a, 1353 Borovnica, registration number 8908087000, VAT number SI57067694 (hereinafter referred to as “Floridus aroma” or “Seller” or “We” or “Our”). Please read these Terms carefully before ordering any products from our Online Store. These terms tell you who we are, how we provide products to you and how we may change or end the contract, what to do if there is a problem and other important information. You should understand that by ordering any of our products, you agree to be bound by these Terms. You should print a copy of these Terms for future reference.

Floridus aroma reserves the right to modify and/or change these Terms from time to time, and your continued use of the Online Store or any part thereof following such changes shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Terms have been changed. If You do not agree to any changes to the Terms, then You must immediately stop using the Online Store.

The Terms of the Online Store are compiled in accordance with the Consumer Protection Act, the Personal Data Protection Act (ZVOP-1), the EU General Data Protection Regulation and the Electronic Communications Act (ZEKom-1) and determine the operation of the Online Store, the rights and obligations of the Customer and the Seller, and regulate the business relationship between the Seller and the Customer.

The Customer is bound by the Terms and Conditions that are valid at the time of placing an online order. When placing an order, the Customer is reminded of the Terms.

The Seller undertakes to always provide You the following information:

Images, graphics, text design are the property of the Floridus aroma. Items may not be copied for distribution and commercial use, nor may they be modified or republished on other websites. Use is permitted with the consent and in agreement with the owner. All comments please send at info@floridusaroma.com  and the company SELFFLES d.o.o. will provide a written answer no later than the legal deadline. The Online Store is open every day, 24 hours a day. Due to various technical reasons, business through an Online Store or even access is sometimes not possible.We reserve the right to make any changes to the General Terms and Conditions without special notice. These are valid from the moment of publication.

2. BASIC CONCEPTS 

The Customer is a person who orders and pays for at least one product on www.floridusaroma.com. The order is valid if the Customer is an adult (18+).Wholesales are not possible through the Online Store at www.floridusaroma.com. Please contact the company directly at sales@floridusaroma.com.

 

2.1 REGISTRATION OF USERS

You can sign up as a registered user. The contents of our Site are also accessible to anonymous non-registered users (guests). In the registration procedure the registered users submit the required data. Every registered user gets their own username and a password which is confidential. The user is obliged to ensure that their username and password will be managed solely by themselves or by a person authorized by them. Every user is independently responsible for contents which are entered by them anywhere on the Online Store http://floridusaroma.com. The final buyer in Our on-line shop is solely the registered or non-registered (guest) user who buys goods for personal and non-commercial use.

The Seller is not responsible for the correctness and completeness of the data entered when ordering or registering.

3. ELECTRONIC COMMUNICATION 

Visiting our Online Store is an electronic communication and the Customer agree that all notices, agreements and other documentation are legally equivalent and valid in legal terms as writing documentation. Advertising e-mails will contain components that will be clearly marked as advertising messages. The sender will be clearly identified, promotions, special discounts and other marketing techniques will be clearly marked as such with clearly defined conditions of participation in them. The Customer’s wish not to receive advertising messages will be respected by the Seller.

4. PRICE AND CUSTOMS

4.1 All prices in the Online Store are shown in EUR ( except local currency HR) and include VAT, unless explicitly stated otherwise. All Online Store prices are the prices of the products and do not include shipping costs, unless explicitly stated otherwise. All prices are valid only for orders placed in the Online Store.

4.2 All orders placed on Our Site will be charged in EUR regardless of the country you are in or the final shipment destination.

4.3 Prices are liable to change at any time, but changes will not affect orders for which We have already sent you a Dispatch Confirmation.

4.4 International orders may be subject to local and national import taxes and duties which may be applied when the delivery reaches that destination, and which are your responsibility where they apply.

If so, the shipping company will contact you once your products are in customs to let you know the cost. Be aware that this may delay your delivery time and if products are held at customs, it will be your responsibility to pay the necessary charges to any national or local authorities and to arrange the release of the products. If you choose not to pay the necessary charges to local authorities to release the products, We reserve the right to charge any additional costs incurred to Us by you. We have no control over these charges, as duties and taxes vary from country to country and may depend on what products have been ordered. We are unable to provide you with an estimated cost and you should contact your local customs office for further information before placing your order. We will not refund to you any sums in respect of products that are held at customs.

4.5 The Seller will periodically publish the promotional prices of certain products and duration of the promotion.

4.6 Despite update, price information may be inaccurate. In this case, the Seller will allow the Customer to withdraw from the purchase, and at the same time will offer a solution for mutual satisfaction.

5. PRODUCT INFORMATION 

All information about products in Floridus aroma Online Store are for informational and educational purposes only, NOT for preventive measures and the promotion of products as medicines. Information is not medical advice, prescribed therapy, or diagnosis, do not contain complete medical data. Therefore are not a substitute for professionalism, knowledge or a recommendation for any form of treatment. Product information should not be used to diagnose or treat the disease without first consulting a doctor. The Seller assumes no responsibility how the Customer will use the information published in the Online Store. The Seller can advise by phone or e-mail, but the Customer takes the advice and their implementation or any damage at his own risk. Photographs of products are not necessarily identical in all details to products ordered by the Customer, which does not mean inferior quality.

6. PRODUCTS AVAILABILITY

 Sometimes may happen that the quantity of products in the Online Store does not match the quantity of products in the warehouse. If the ordered product is not currently in stock, the Customer will be notified of the new delivery time. The Seller will offer another product that is closest in composition and effect to the first one.

 

7. HOW THE CONTRACT IS FORMED BETWEEN YOU AND US

 

7.1 Order accepted

The Customer selects the desired product by clicking on the “add to cart” icon. By clicking on “add to cart” you can always check which products are already in the cart. When the Customer finishes selecting the products, he clicks on the “continue to checkout” icon, which connects the Customer to the form. In the order form, the Customer enters all the necessary information, selects the method of payment and the method of delivery. By clicking on the “buy now” icon, the Customer places an order. After placing the order, the Customer receives an order confirmation by email. With this, the order is accepted.

The Customer has the option to cancel the order within one hour of placing the order. The Customer can send errors, corrections or additions to the order by e-mail or by phone. If the Customer does not receive the order confirmation by e-mail, it means that there has been a technical error or incorrectly entered data. Please check the spam, repeat the process, or send an email at info@floridusaroma.com.

 

7.2 Order confirmed

The contract between the Customer and the Seller (“Contract”) will only be formed when We send you the Dispatch Confirmation.

The Contract will relate only to those products whose dispatch We have confirmed in the Dispatch Confirmation. We will not be obliged to supply any other products, which may have been part of your order until the dispatch of such products has been confirmed in a separate Dispatch Confirmation.

 

7.3 Products shipped

The Seller prepares and sends the products within the agreed deadline.

 

8. PAYMENT METHODS

For the territory of EU countries, the Customer can choose the following payment methods during the ordering process:

In the case of bank transfer, upon confirmation of the order, the Customer receives a proforma invoice by e-mail, and the goods are shipped to him upon receipt of the payment or the receipt of funds to the Seller’s account (provided that the goods are in stock or as soon as We receive the goods in storage) .

You can pay your order online by (i) PayPal, whereas PayPal’s terms and conditions shall apply exclusively, or (ii) by credit card. The Customer may need to have a user account with the respective payment system provider.

Until the entire payment price is paid, the products chosen are the property of Floridus aroma.

 

9. DELIVERY/SHIPPING

We will deliver the purchased products to you within the deadlines specified when placing the order. Floridus aroma Online Store ships internationally. Shipments within European Union (EU) are delivered by GLS. Recipients receive an email containing information about the upcoming delivery of GLS parcels.

It typically takes 1-3 business days for orders to process and leave our warehouse. Processing times do not account for weekends or holidays. Orders are processed in the order in which they are received. Shipping costs may vary depending on weight, postal code, country.

 

If our supply of the products is delayed by an event outside our control, then We will contact You as soon as possible to let you know and We will take steps to minimize the effect of the delay. Provided We do this, We will not be liable for delays caused by the event, but if there is a risk of substantial delay You may contact us to end the agreement and receive a refund for any products that you have paid for but not received.

We are not responsible for any delays on the part from the contractual partners for the delivery or for any damage to the packaging. You should immediately inspect the received goods and in case of any physical damage, lack of any goods or signs of being opened beforehand, immediately contact the contractual partner for the delivery to initiate the complaint procedure with the delivery service.

 

Please note that customers from non-EU countries are responsible for any possible import customs and taxes.

 

10. RIGHT OF WITHDRAWAL

 

10.1 Right to withdrawal

In accordance with the Consumer Protection Act You have the right to withdrawal from this contract within 14 days without providing any reason. The withdrawal period will expire after 14 days from the day on which You acquire, or a third party other than the carrier and indicated by You acquires, physical possession of the products. To exercise Your right to withdraw, You must inform Us of Your decision to withdraw from this contract by an unequivocal statement (a letter sent by post or e-mail). To meet the withdrawal deadline, it is sufficient to send the communication concerning Your exercise of the right to withdrawal at info@floridusaroma.com before the withdrawal period has expired (name and date of the order included).

 

10.2 Effects of Withdrawal

If You withdraw from this contract, We shall reimburse to You all payments received from You, including the costs of delivery, without undue delay and in any event not later than 14 days from the day on which We are informed about Your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as You used for the initial transaction; in any event, You will not incur any fees as a result of such reimbursement. However, please note We are entitled to withhold reimbursement until the products have been returned to the address specified below.

You shall send back the products or hand them over to Us without undue delay and in any event not later than 14 days from the day on which You communicate Your withdrawal from this contract to the following address: SELFFLES d.o.o., Dol pri Borovnici 58 a, 1353 Borovnica, Slovenia by registered mail. The deadline is met if You send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods.

The products must be in their original condition and with original packaging.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

The right of withdrawal within 14 days without providing any reason shall be applicable only to consumers (natural persons).

When returning the products, copy of the invoice and cancellation form shall be sent to the Seller by email at info@floridusaroma.com. You may use the cancellation form provided herein, but you are not obliged to do so. Your feedback is highly appreciated and will help us improve our products and our ability to serve You better.

The Seller is not responsible for any damage during the delivery.

The Seller is not obliged to accept packages with postage not paid.

Unless the contracting parties have agreed otherwise, the Customer has no right to withdraw from the contract referred to in the first paragraph of this Article in the case of contracts:

  1. on the supply of sealed goods which are not suitable for return for reasons of health or hygiene reasons, if the consumer has opened the seal after delivery;
  2. on goods made to order by the consumer and adapted to his personal needs and wishes;
  3. on goods which are perishable or expire quickly.

 

11. CLERICAL DEFECTS

We are responsible for clerical defects of the products purchased on our Online Store. You notify Us by mailing at info@floridusaroma.com. You must describe the defect more specifically in the notification and provide the possibility for the seller to review the product.

You are also required to add a copy of the original invoice. The products with a copy of the invoice must be sent within 14 days after submitting the written notification to Us.

We will, within eight business days upon the receipt of the written notification, confirm that we have received the complaint and submit a written reply with regards to solving the complaint claim.

You may submit a complaint due to a material defect of the product within two months from the day, when the defect was discovered.

We are not responsible for material defects on products, shown after two years have passed from receiving the product.

 

12. MATERIAL ERROR AND COMPLAINT

 

12.1 Actual error

The Customer, who has correctly notified the Seller of the defect, has the right to require the Seller to:

– rectify the defect in the goods,

– returns part of the amount paid in proportion to the error,

– replace defective goods with new faultless goods,

– returns the amount paid.

All our products are properly stored in the original packaging.

The shelf life stated on the packaging is only valid if stored correctly. Due to natural ingredients, products can differ in color, smell and appearance.

12.2 Reclamation

In case of dissatisfaction with our products, you can send a complaint to email at info@floridusaroma.com.

If product is damaged during delivery, contact the delivery service. Carefully inspect the shipment in the presence of the courier. The product complaint can only be claimed by the Customer listed on the original invoice. Complaints cannot be filed in the following cases:

– in the case of damage caused by improper use, negligent handling, mechanical damage or in the event of force majeure,

– in the event of misuse or the consequences of negligent conduct,

– if the customer has already opened the security seal or unpacked the product from the original packaging.

 

13. DISPUTE RESOLUTION

The Seller follows the applicable consumer protection regulations. The Seller has an effective customer support system for resolving complaints and employs a person that can be contacted by Customer via e-mail in case any issues occur. In case of issues or a wish to appeal the Customer can contact the Seller via the email address at info@floridusaroma.com. The complaint processing procedure is confidential.

The Seller will confirm that the complaint has been received within eight working days and the guarantee claim will be resolved within the statutory deadline. The Seller will strive to resolve any dispute under mutually agreed conditions. If a mutually agreed upon solution can not be reached, all disputes between the Seller and Customer will fall under the jurisdiction of the appropriate court.

These Terms and all disputes between the Seller and Customer fall under the jurisdiction of Slovenian law.

 

14. OUT-OF-COURT DISPUTE RESOLUTION

In accordance with legal norms, Floridus aroma does not recognize the authority of any out-of-court provider for settling disputes, launched by the Customer.

If the Customer is not satisfied with the resolution of the complaint, they can, in accordance with applicable legislation, file to initiate the procedure of out-of-court settlement of a specific consumer dispute through the European Commission for Online Dispute Resolution. In accordance with regulation (EU) 524/2013, Floridus aroma is publishing a link to the European Commission for Online Dispute Resolution: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=EN.

The Customer can also decide to file a lawsuit with the competent court according to the Customer permanent address.

That regulation derives from the Out-of-Court Settlement of Consumer Disputes Act, Regulation (EU) no. Regulation (EC) No 524/2013 of the European Parliament and of the Council on the online settlement of consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22 / EC.

 

15. LIMITATION OF LIABILITY

We do not take the responsibility for eventual consequences which may occur when using Online Store and the contents included in it. We reserve the right to change the content of our Online Store at any time without prior notice and do not take the responsibility for eventual consequences of these changes. We strive to introduce the most punctual and up-to-date information as possible, but do not exclude eventual inaccuracy of information as far as the prices, delivery time, product descriptions etc. are concerned, and cannot be held responsible for any eventual damages or other consequences. Although the Seller attempts to provide accurate images of the products sold in the Online Store, all photographs should be considered symbolic and may not represent their actual state of products (color, materials etc.). Images do not guarantee the properties of products featured on the Online Store.

 

16. LIMITED RIGHT OF USE

Subject to your acceptance of and compliance with these Terms, Floridus aroma grants You a limited, personal, revocable, non-exclusive, and non-transferable license to use the Online Store solely for Your non-commercial and personal purposes as defined herein. Any commercial use is prohibited, however, and notwithstanding this prohibition, You are allowed to use the Online Store in a non-modified form for viewing purpose.

Your right to use the Online Store is limited to the license grant as defined above and You may not otherwise copy, display, seek to disable, perform, distribute, publish, transfer, modify, create works from, our use the Online Store or any component of it, except as expressly authorized by Floridus aroma in writing in advance.

In no event, You may use the Online Store in a manner that:

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the Online Store shall remain at all times vested Floridus aroma or our licensors. You are permitted to use this material only as expressly authorized by Floridus aroma or our licensors. You acknowledge and agree that the material and content contained within the Online Store is made available for Your personal non-commercial use only.

 

17. INTELLECTUAL PROPERTY RIGHTS

The Intellectual Property Rights on the Online Store and the materials on or accessible via it belong to FLORIDUS AROMA j.d.o.o. or its licensors. The Online Store and the materials on or accessible via it and the intellectual property rights therein may not be copied, distributed, published, licensed, used or reproduced in any way (save to the extent strictly necessary for, and for the purposes of, accessing and using this Website). “Floridus aroma” is a trademark, which belongs to FLORIDUS AROMA j.d.o.o. and it may not be used, copied, or reproduced in any way without written consent from Floridus aroma. All trademarks not owned by Floridus aroma are the property of their respective owners and are used with permission. Nothing contained on this Online Store may be construed as granting, by implication, estoppel, or otherwise, any right or license to use any trademark. For these purposes “intellectual property rights” includes the following, but is not limited to (wherever and whenever arising and for the full term of each of them): any patent, trademark, trade name, service mark, service name, design, design right, copyright, database right, moral rights, know-how, trade secret and other confidential information, rights in the nature of any of these items in any country, rights in the nature of unfair competition rights and rights to sue for passing off or other similar intellectual or commercial rights (in each case whether or not registered or registrable) and registrations of and applications to register any of them.

 

18. ERRORS AND OMISSIONS

Floridus aroma assumes no responsibility or liability for any errors or omissions in the content of this Online Store. The information contained in this Online Store is provided on an “as is” basis with no guarantees of completeness, accuracy, usefulness, or timeliness and without any warranties of any kind whatsoever, express, or implied. Floridus aroma does not warrant that this Online Store and any information or material made available on the Online Store, will be uninterrupted, error-free, omission-free, or free of viruses or other harmful items.

 

19. SECURITY

To protect the security of Your information during transmission, We use Secure software, which encrypts information sent through the orders. Software allows a secure connection between your web browser and our web server, using a private (or secret) key to encrypt the information. This encryption provides greater consumer protection than many forms of offline credit card payments.

However, please note that there’s no such thing as completely secure data transmission, therefore We can’t guarantee that our security will not be breached.

21. CUSTOMER COMMENTS, FEEDBACK, AND OTHER SUBMISSIONS

If, at Our request, You send certain specific submissions (for example product review) or without a request from Us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, ‘comments’), you agree that We may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

22. COLLECTION OF DATA

The Seller attaches great importance to the protection and safety of the Customer’s personal data. All the relevant information is contained in Our Privacy Policy as amended from time to time, which is part of these Terms.

 

23. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by the laws of the Republic of Slovenia, without recourse to the UN Convention of Contracts for the International Sale of Goods. If the Customer is a trader or a legal person under public law, the exclusive place of jurisdiction for any disputes arising out of this contract shall be Ljubljana, Slovenia.
